Art Scams: Protect Yourself

We artists work hard to eek out a living. It takes everything we have (and then some) just to survive. So when people try to scam us, it makes me angry.

Here’s the first email I received today via my Fine Art America site:

From: Thomas Sorensen sorensgear@att.net Subject: Original Artwork – Heart of Gold 1 Message: Hello, I am interested in your paintings.I would like to know about the original of this very one, “Heart of Gold 1” if it is ready and available as i want to have it picked up as soon as possible at the price of $2,700.00. let me know regards, Sorensen

It contained red flags so I ignored it. What to look for? It was not  addressed to me personally, the price was $200.00 more than the listed price and he wanted to have it picked up rather than shipped, yet he did not know where I was located.

Then I received this one:

From: Thomas Sorensen sorensgear@att.net Subject: Original Artwork – La Familia Message: Hello, I am interested in your paintings.I would like to know about the original of this very one, “La Familia” if it is ready and available as i want to have it picked up as soon as possible at the price of $5,100.00. – Hide quoted text – let me know regards, Sorensen

He had the price right on this one but there was still no name attached and it was as if he didn’t remember his earlier email. I responded to both emails just to see where he’d take it.

Here’s how he replied:

Hi Shannon,

Thanks for the quick response.Your art works are really a beauty to behold. I will like to have Heart of Gold 3 and 4 at a total price of $5000 USD. How much is la Familia ? I also would like to know the weight of all when packed ready because i have a pickup agent coming for it after payment, so you do not have to worry about shipping.
Write me your location and paypal account email.
let me know this immediately…

The red flags continued.It’s as if “Thomas” was not connected to the last email where he clearly knew the price of La Familia. Again he offered an agent for pick up, and he wanted my paypal info. Further, this email was signed Thomas rather than Sorenson.

I sent a reply email blasting him for targeting artists. And then I thought, what if you are a new artist, and you don’t know what to look for? Here are some great resources that explain the details of the scams…

I still love Fine Art America. They are a great company, excellent customer service and they pay on time!  So if you are thinking of selling your images, it’s a great place to be. Don’t be afraid to sign up, just be cautious of emails from people who are trying to buy outside of the system.

When the funds arrive Malta, I will give the person a 5% commission and use the balance of the funds for my on-going project in Gozo.

This is because it is easier to move funds to your island if paying for goods or services than for no tangible reason.

I have looked at your profile and I see you have a great talent.

I can buy your art work and make your work public by putting an 8 Million euro tag on your Painting and you can sale it in future for nothing less than this amount.

I have done this in the two years ago in Milan and now its your opportunity.

    just wanted to thank you for posting this information about art scam.
    Two days ago I received the same letter: from Thomas Sorensen via FineArtAmerica site.
    I was in doubt from the beginning, but replied twice to see where the catch is. Then I searched his email address on GOOGLE – it is not listed anywhere except your site! So grateful, you wrote about it to warn other artists! Now I know for sure it is a scam!
    I think he targets artists on FineArtAmerica! I wanted to report this to site organizers, but could not find a proper button for this.

    He say’s that he want to buy a present for his Daughter as he’s written to all of you here in this forum.
    I looked him up and this is a scam without a doubt!!

    This is what he wrote:

        These guys are nothing more then thiefs…
        I belive it could be people with stolen credit cards that wants to buy art so they can sell it further later on!!

        We’ve got a couple of these scams in Sweden since like 3 years back.
        They buy with stolen cards and then store the paintings for awhile and the sell it further, emptying the accounts and get their money anyway..

        Be carfull with these kind of e-mails…
        Does anyone know if the police is involved?, I meen, He uses the name’John’ quite often and is probably located in England, is there worth to contact them?

    I also got mail from Mr. Baylor about buying an artwork for his daughter’s wedding on 2nd June. From the start I had a certain negative feeling on the email since it was without my name and he asked for a catalogue.I responded to his mail and even called him last night. This was a weird call. He said ‘yes’ on everything and though his name looks English, I think he probably is East European, but certainly not English. There were also little children to be heard in the background.
    He asked for bank details which I gave him by email because I said he had to transfer money before my shipping the artwork.     My name is Dunja and I work with the artist Alejandro Hermann in Marbella, Spain. I received the exact same email from Mervyn Baylor, from the same email address rsmith0223@yahoo.com. I answered initially even though it sounded strange right from the beginning. He even sent us a cheque to pay for a painting but it was made out to a sum almost 3 times the one of the painting. Thats when all the remaining alarm bells rang and I googled him and found the art fraud alert. Thank you so much for posting your warnings . That helped sooo much . Will report this case to the police, for sur and will warn all the other galleries we know. Unbelievable …. What an oranisation they got there. Would like to know how many deals he/they make……

I have found that high page views do not necessarily translate into sales. I don’t have a problem with Fine Art America.I have a problem with the people who go there solely to scam artists.

      I have had a few scam emails from FineArtAmerica visitors but I have also just had a very positive experience to report. Someone contacted me from England about purchasing the original of one of my paintings on FineArtAmerica – I emailed her back with specifics and the price, as well as PayPal information. Within 15 minutes my buyer had sent all the $$ to PayPal – these funds were deposited to my bank account with no problem. After a month, my UK buyer sent me the address for shipment of the painting. The whole transaction was a pleasure with no problems.

      I would not have sold my original artwork without having it on FineArt America.com – you have to take a chance AND be sensible. The ONLY way to go is PayPal for this kind of situation – no checks, cashiers or otherwise and no credit cards. Do it through PayPal and you should be OK. ALWAYS get paid BEFORE shipping anything. Happy Art Sales!

    You may be interested to know that M. Martin George now goes by the name of Chris Buhlinger, same address, same crap. He wishes to buy a graduation present for his dear wife, and will of course send me a cheque very soon (he is in a hurry)!
    I do not understand the point of these scams; does it mean that some people are naive enough to just send them their artwork without having been paid beforehand? Could we not undertake a class action against them?

    I have made my personal enquiries, and here is how the scam works:

    They will send you a cheque, with a slight “error”, maybe 10% too much, and will ask for the refund of that tiny mistake. Of course their cheque will bounce back (did you know that after having credited an amount to your account the bank may take it back afterwards-10 days up to 2 months later- if your debtor does not have the funds?)
    So you will end up having paid good money to these crooks, while having received nothing, plus your art piece you will have sent them!

    Conclusion: NEVER ACCEPT CHEQUES, ONLY BANK TRANSFERS AND PAYPAL

    I wouldn’t have otherwise suspected anything, but the client was ignoring my questions and comments, so I started to Google the name and found from here the same phone number as my “contact”.

    I am glad I found this site with the information, otherwise we would have waisted a lot of time and efforts for the fraud.

    Shame on the people who do this!

    This happened to us too , regarding booking our venue for a wedding.. the emails have been word for word what is appearing here . We were suspicious but went along with it until they sent us a cheque for nearly double the amount of money !!! then we were really suspcious and googled it and came here Thank you for posting , you have just saved us a problem..

    Im guessing now we dont do anything, dont bank the cheque either !! Please advise what the follow up is if anything

    Thanks for all the information you shared. I am from the Netherlands and received last month about the same emails from mr. Martin George, the oil engineer. The content is very similar with emails sent by others too (or are they all from the same person?) . Hurry, wedding anniversary present, stuck in the Gulf of Mexico, he will send me a cheque by courier. Although I fortunately did not send my works yet, it took me a lot of time. It seems that his/her home address changes, but the telephone number often seems to be the same:
